Judge lets NAACP pollution lawsuit against xAI proceed
A federal judge denied xAI's motion to dismiss an NAACP lawsuit accusing the company of operating at least 35 combustion turbines at its Colossus data center near Memphis without required air permits, in violation of the Clean Air Act. xAI argued the turbines were exempt as mobile sources and that plaintiffs lacked standing, but Judge Debra M. Brown rejected both claims. The NAACP's environmental justice director called the ruling another victory in efforts to hold xAI accountable, noting courts have repeatedly rejected dismissal attempts by both xAI and the Department of Justice.
